  8. Your Honour, The Defense believes the motion for separation of trials by the Prosecution to be made in an effort to inundate the small defense team with an overwhelming amount of cases. The Defense therefore objects to the Prosecution's motion on basis of the following reasons: - The Prosecution chose to keep the case in one place when they indicted the Defendants together, as opposed to indicting them individually; - The Prosecution has a considerably larger workforce than the two-man defense team, and would therefore be able to better handle multiple cases at once. A separation of the trials would impair the defense team's ability to adequately defend each Defendant; - The evidence and general case is the exact same against each Defendant, with varying levels of severity and supposed involvement. Essentially the Prosecution is motioning to hold ten identical trials, as opposed to holding one. Therefore, in granting this motion, the Court would be infringing upon the Defendants right to a fair trial without unnecessary delay, as secured by the sixth amendment to the Constitution.

    Application for CAF Order in The People v. Joe Pemm

    Your Honor, The criminal case People v. Pemm has concluded with a guilty verdict and a warrant issued. The Defendant refused to speak with his own attorney, and so the case was decided in summary judgment. The State would therefore like to re-petition this honorable court for a CAF Order.
