DEPARTMENT (e.g. Florida State Police ) RESPONDENT **DISCLAIMER: IF POSSIBLE, YOU MUST FIRST APPEAL INTERNALLY WITHIN YOUR DEPARTMENT YOU MUST BE LISTED AS ACTIVE ON THE FLORIDA STATE POLICE ROSTER PRIOR TO DISCIPLINE (10 Hours a Week) TO PLACE A SENATE APPEAL** Information Trooper's Name: Patrick Lee Organisation: Florida Highway Patrol Rank: Lt Department: SWAT Badge Number (If Applicable): 125 Punishment you were given: 5 Points Grounds for Appeal (Why should it be overturned): On Wednesday the 20th of September I attended a major crime involving CTRG and Trafficante (CTRG and Trafficante alligned). CTRG took an officer hostage within the main PD in Orlando, Captain Lewis Miller negotiated with the taker and agreed on free passage. The CTRG member took this free passage and hopped into a blue lada driven by another CTRG member that was waiting for him outside of the main PD. Three police cars actively chased this vehicle whilst i shadowed the pursuit in mine, this was in case of any interference vehicles or more members of CTRG / Trafficante wanting to get involved. After around five minutes of chasing, the blue lada was successfully S1d, it was at this time a black BMW driven by a trafficante member arrived on scene and attempted to pick up the 2 CTRG individuals. Officers exchanged shots with the CTRG members at this point and downed the 2 suspects before they could get into the bmw. At this stage the BMW took off from the scene and headed towards me, I decided to block the road and try apprehend the suspect driving the BMW due to his clear involvement in the major crime. The BMW struck the side of my vehicle and launched my car down the road whilst blowing up the BMW in the process. I crawled out of my wrecked vehicle after the collision and pulled out my class 3 firearm, at this time the trafficante member was in a snake like posture on the ground however he was moving at athletic speeds, the suspect in my POV was attempting 1 of 3 options; 1. Take the officer next to him hostage 2. pull his firearm and shoot officers 3. Attempt to get behind a tree before pulling his firearm. Due to the suspects ungodly posture, shots already being exchanged, the speeds he was moving towards my probationary officer and the suspect looking like he was attempting to strike my probie officer with his rifle, I decided i would neutralise the suspect and this was achieved with a single shot to the head. I believe I was acting in the best interest of the FHP and the citizens of Flordia and believe that under the major crime use of force policy I was well within my right to match the Major crime class of weapon to take out this individual that was clearly involving himself within said major crime. The major crime use of force policy also clearly locks us to use said class of weapon throughout the whole major crime against suspects and has no wording to suggest otherwise. There is no mention whatsoever in the GSOPs to imply that we may use non lethal options when at major crimes that are using firearms and it clearly implies deadly force is the only option available. The suspect also clearly had no intention of following orders given by the FHP due to his drastic movements away from the RTC.
