After careful deliberation on the facts and evidence presented, I will find the following:
1. Mr. Lewis Castiglione was in possession of a Class 3 Firearm and took a Sgt+, Lt Hoenrik Wang, hostage. Furthermore, Mr. Castiglione used his law enforcement powers to use said “legal” firearm to benefit himself in responding to what would have been a simple warning/counseling session and escalated the situation into criminal behavior which is against his oath of service and obligations as an Alaska State Trooper. Finally, I find that the defendant did in fact perform negligently as a Senior Trooper injury to Lt. Wang and his fellow AST members who had to witness this criminal behavior and ultimate betrayal.
Injury - harm suffered by a person due to some act or omission done by another person
Harm - loss of or damage to a person's right, property, or physical or mental well-being
2. I find it appalling that a former Senior trooper charged to protect and sever would act so disgusting and cowardly when faced with adversity. The behavior of Mr. Castiglione is despicable and can not be tolerated. The AST leadership sent that message with administrative discipline and this court is prepared to meet the Judicial.
Therefore, the ruling will be as follows:
As to Count 1 - §11.1.270 Kidnapping, Plead Guilty/served time prior upon arrest- DISMISSED
As to Count 2 - §11.1.300 Abuse of Public Office, GUILTY (40 months, $50K fine and removal from AST)
As to Count 3 - §11.1.660 Felony Malpractice - Reduced to lesser included (no gross bodily harm, false conviction or death)
§11.2.260 Misdemeanor Malpractice, GUILTY (15 months)
SENTENCE WILL BE AS FOLLOWS:
Mr. Lewis Castiglione you are ordered to turn yourself into the authorities immediately to serve out your sentence of 55 months and pay your $50,000 fine. Failure to do so peacefully will result in an additional charge of §11.2.140 Contempt by Breach of a Court Order and would subject you to a punishment of an additional 15-30 months or a $250,000 fine. This applies to both conditions separately.
Should Mr. Lewis Castiglione fail to comply, he will be apprehended and remanded into the Custody of the Department of Corrections in Kings Peak Alaska to serve his sentence of no less than 55 Months. The above order will be in force should it need to be exercised and the warrant is attached.
