Application for CAF Order in The People v. Joe Pemm

What other remedies have been taken in order to satisfy this debt.  Has he been arrested for the evasion,  been to criminal or civil court and ordered/refused to pay?

Chief Justice,

Mr. Pemm has been warned numerous times and every time he has been warned he has declined to pay on every occasion. When he was made aware of the Department of Revenue's intentions to file for a CAF Order, he abruptly said: "Better get my house cleared then". Mr. Pemm has shown a blatant disregard for his outstanding tickets, which has now reached an amount in excess of $330,000.

Mr. Pemm has been arrested for Felony Tax / Fine Evasion 4 times in the past 10 days alone - it should be noted though, that Mr. Pemm has been a prime suspect for many months, and has been known as an intentional tax evader since the beginning of the Revenue Enforcement Administration. In the Revenue Enforcement Administration, it is standard procedure to make a suspect aware of the consequences when being arrested and incarcerated. All arrests and warnings considered, it is safe to say that Mr. Pemm is well aware of the consequences of his actions - he simply doesn't seem to care. We in the Department of Revenue believe the time has come for us to take a more drastic tool in use, in an attempt to hopefully retrieve some of the money the State is owed.

If you are filing the paperwork you would include this narrative in a civil civil complaint and ask that the remedy include a CAF order from the court.  

The respondent must have an opportunity to be heard in court to defend themselves through a trial on the forums.

Not saying I can not hear it as law says this court will approve/disapprove CAF orders.   Just submitt in in a complaint that can be responded to in the format above, as mentioned

.  I will grant time for a response and then a ruling will be made.  You cant just say hand over a list of assets.

 If approved the court will coordinate with the state and determine what assets are to be siezed/auctioned and have to proceeds paid returned to the court to then be awarded accordingly.

Your Honor,

The criminal case People v. Pemm has concluded with a guilty verdict and a warrant issued. The Defendant refused to speak with his own attorney, and so the case was decided in summary judgment. The State would therefore like to re-petition this honorable court for a CAF Order.

Now that the tickets are confirmed and the lower court has convicted Mr. Pemm and adequate time to pay has been afforded to the defendant.

The CAF application will be APPROVED.  The CAF actions will be executed administratively by Mr. Conor Lee @Conor Lee and $315,000 will be awarded and turned over to the REA office.

So Ordered.
